Please read this agreement carefully. Upon entering into an agreement, you the Hirer, agree to be bound by the terms within.

DEFINITIONS

  1. ‘We’, ‘Us’ and ‘Our’ means Flabbergast Entertainment, the supplier of goods and equipment.
  2. The ‘Hirer’, ‘You’, ‘Your’ is the person named on the booking form and who has also agreed to all the terms and conditions.
  3. ‘Goods’, ‘Order/s’, ‘Item/s’ means all goods and equipment hired by Us to the Hirer.
  4. Placing an order with Us verbally, by phone, Internet or any other method of communication constitutes You having read, understood and agreed to these terms and conditions.

PAYMENTS

  1. All percentages are based on the total invoice value of the booking.
  2. 50% is due upon confirmation of your booking request. This includes a 15% non-refundable deposit.
  3. The 50% balance is due at least 5 days before Your event date. If the booking is made within 5 days of Your event date then 100% of the invoice value will be required which will include the 15% non-refundable deposit.
  4. The preferred method of payment is by bank transfer. Cheques are not accepted.
  5. Delivery will not be made without receipt of the full invoiced balance and security deposit transaction.
  6. We reserve the right to cancel your booking if payment is not received when due.

SECURITY DEPOSIT

  1. A security deposit will be collected up to 5 days before Your event.
  2. The sum of money is dependent upon the value of the goods being supplied and is held as a deposit against the safe and prompt return of the goods under hire.
  3. The replacement cost of all losses and damages will be taken from the payment method used to provide the security deposit.
  4. Where the value of the security deposit does not cover the total cost of losses and damages, Flabbergast Entertainment will charge the Hirer for the balance.
  5. Substitute items will not be accepted and all damaged items remain the property of Flabbergast Entertainment and should therefore be returned.
  6. Deposits will be returned to the Hirer within 7 days of the event, subject to no damages to the Flabbergast Entertainment equipment.

CANCELLATION AND CHARGES

  1. If, for any reason, you wish to cancel your order you should telephone; 07942 345050 or email us at hello@flabbergast.co.uk in the first instance.
  2. Cancellations up to 30 days before Your event date will be exempt from a cancellation charge except for the 15% non-refundable deposit.
  3. Cancellations between 5 and 29 days before Your event date will be charged at 50% of the total contract price, which includes the 15% non-refundable deposit.
  4. Cancellations made 4 days or less before Your event date will be charged at 100% of the total contract price, which includes the 15% non-refundable deposit.
  5. For cancellations due to the weather, see our ‘Weather’ section below.

DELIVERY AND COLLECTION

  1. Deliveries and collections will be made in person by a Flabbergast Entertainment representative.
  2. You or an appointed person will be required to inspect and sign for the goods at the time of delivery.
  3. Any person other than the Hirer who signs a delivery/collection note is deemed to be authorised to do so. Any discrepancies to the order must be notified within 8 hours of the delivery. Any discrepancies that are not notified during this period will be exempt from any credit/refund.
  4. The Goods remain Your responsibility until they have been collected by Flabbergast Entertainment. You should therefore make every effort to ensure goods are kept dry and are retained in a secure place until this time.
  5. We will make every effort to collect and deliver your order at the specified times however we will not be liable for any loss arising directly or indirectly from any delay in the delivery or collection of the goods.

EQUIPMENT

  1. All Goods remain the property of Flabbergast Entertainment, 5 Ashley Road, Middleton, Market Harborough, LE16 8YP.
  2. The Hirer agrees to be responsible for the safekeeping of all the equipment whilst on hire.
  3. The equipment must be supervised at all times by a responsible adult, over the age of 18 years old.
  4. We do not accept liability for any accident, injury or damage that may occur whilst the equipment is on hire to the Hirer.
  5. Children must be supervised at all times.
  6. We will leave the setup as safe and hazard-free as possible and show the client of any trailing leads to be aware of.
  7. No smoking or barbecues to be allowed near Our equipment.
  8. We reserve the right to substitute an item for an alternative. I.E. if breakages, delayed returns, lost items have occurred as a result of a previous customer order.

DAMAGED GOODS

  1. The Hirer shall be solely responsible for the hired Goods at all times.
  2. Shortages and damage to hired Goods will be charged at the full replacement cost. No substitute item will be accepted by Us.
  3. If Goods are not returned at the end of the agreed hire period We have the right to charge for the cost of replacement Goods.
  4. We will inform the Hirer within 7 days of any damages or missing items concerning any of the hired Goods. An invoice will be sent outlining the amount of damage and costs.
  5. Details of these charges are available upon request.

WEATHER

  1. Some of the equipment is for outdoor hire and is dependent on fair and good weather. If the weather forecast up to 24 hours before the hire day is for persistent rain and /or strong winds, we will contact you to discuss what options are possible such as; an alternative indoor venue, postpone to another available date, or use of one of our gazebos. Refunds due to weather is refunded at Our discretion.
  2. All of Flabbergast Entertainment’s outdoor equipment is not suitable to be used in heavy rain or strong winds (that exceeds 22mph).
  3. If the weather deteriorates during the hire period, the Hirer should apply the weather protection covers supplied without delay and switch off the electrical equipment at the power source. Regrettably Flabbergast Entertainment will not offer a full refund at this point.

WARRANTIES

  1. We warrant that at the time of delivery goods will be of satisfactory quality; however we are not liable for any damages or losses incurred during transit.

LIABILITIES

  1. In no circumstances shall our liability to you exceed the invoice value of the contract.
  2. Flabbergast Entertainment or any of their employees shall not be liable in respect of damages/injury/loss or any other damage incurred in respect of this hire, as a result of any defect or damage to the item and the Hirer shall satisfy himself/herself of the suitability/condition/placement of the equipment upon receipt.

LAW

  1. These items and conditions and any contract formed between us shall be governed by the laws of England and you agree to submit to the exclusive jurisdiction of the English courts.
  2. If for any reason you are not entirely satisfied with your goods your statutory rights are not affected and complaints can be made by telephoning; 07942 345050 or made in writing to Flabbergast Entertainment, 5 Ashley Road, Middleton, Market Harborough, LE16 8YP.

PRIVACY POLICY

  1. Flabbergast Entertainment treats any personal information you provide in accordance with the provisions of the data protection act of 1998 and will only use the information you supply via this website to contact you in connection with services provided and/or to respond to requests you have made to provide any desired information.
  2. Use of the Flabbergast Entertainment website does not require you to disclose any personal information unless you make an enquiry, booking or contact us directly via email.
  3. Flabbergast Entertainment does not sell, trade or rent your information to third parties.

FORCE MAJEURE

  1. Flabbergast Entertainment cannot accept responsibility or pay any compensation where the performance of the booking is prevented or affected by reason of circumstances which amount to “force Majeure”. This includes any event which we could not, even with all due care, foresee or avoid.
  2. Such circumstances include the destruction or damage of the location set for the booking, (which cannot reasonably be redeemed to a satisfactory standard before the start of hire) through flood, fire, explosion, storm or other weather damage, break in, criminal damage, riots or industrial strife, natural or nuclear disaster, adverse weather conditions, war or threat of war, actual or threatened terrorist activity, epidemic and all other similar situations beyond our control.

DISCLAIMER

  1. All persons using Flabbergast Entertainment equipment do so at their own risk.
  2. The Hirer will be responsible /liable for any damage or injury occurring from use or misuse of equipment.
  3. Flabbergast Entertainment take no responsibility for the content that is shown on their equipment, do not arrange or provide any licenses, do not provide any content (movies, Boxsets, Games) and are not responsible for any copyright infringement that may occur when organising an event.
  4. Flabbergast Entertainment is a fully insured business.
